Definitions: In this Agreement, the following terms shall have the meanings ascribed to them:

"Customer" refers to the individual or entity entering into this Agreement with Butinah Charters.
"Company" refers to Butinah Charters, a legal entity providing yacht charter services.
"Agreement" refers to this legally binding contract between the Customer and the Company.
"Vessel" refers to the yacht or boat chartered by the Customer through Butinah Charters.
"Subscriber" refers to the individual holding the membership with Butinah Charters.

1.1 Booking: Each trip requires a pre-booking.
1.2 Rescheduling: Customers can reschedule their bookings up to 7 days before the trip date, with a maximum of 1 reschedule allowed. Rescheduled dates must not fall within 7 days of the initial booking.

2.1 Non-Refundable: All payments, including the Joining Fee and Membership Fee, are nonrefundable, except in cases of Company-initiated cancellations.
2.2 Multiple Payments: Multiple payments are accepted only with prior agreement.

3.1 Usual Terms and Conditions: The Customer acknowledges the standard terms and conditions, including the acceptance of full responsibility for any damages to the Vessel, its contents, or any harm caused to third parties during the charter.

4.1 Identification Requirements: All passengers must carry legally valid identification. International visitors must present passports as identification.
4.2 Safety Compliance: The safety of all passengers is paramount. Life jackets must be worn by all passengers, irrespective of swimming abilities.
4.3 Disclaimers: Disclaimers must be signed before each trip.

5.1 Timely Arrival: Customers should arrive at least 30 minutes before the scheduled trip to ensure a punctual departure.
5.2 Departure Delays: The Company is not responsible for delays caused by the late arrival of the Customer or their guests.

6.1 Late Arrival Options: Late arrival services are available through speedboats at a fee of AED 300, accommodating up to 7 people.

7.1 Damage Responsibility: The Customer is responsible for fully compensating the Company for any damage or loss incurred to the Vessel or its equipment during the cruise, promoting responsible use of the Vessel.
7.2 Prohibited Activities: Certain activities are strictly prohibited, including boarding while wet and using celebratory confetti on board, with violations incurring a penalty of AED 1,000.

8.1 Childcare Responsibility: The Company does not provide childcare services and is not responsible for supervising minors during the trip.
8.2 Minors: Minors must be accompanied by adults.
8.3 Safety Acknowledgment: Customers acknowledge the inherent risks of water activities and agree to follow safety guidelines provided by the crew.

9.1 Material Restrictions: The transport of flammable, explosive, or hazardous materials on the Vessel is strictly forbidden, with violations leading to immediate trip termination and potential legal action.

10.1 Belongings: The Company is not responsible for any loss or damage to personal belongings brought on board.
10.2 Medical Conditions: Customers must inform the crew of any relevant medical conditions that may affect their safety during the trip.

11.1 Itinerary Adjustments: The Company may modify the trip itinerary or route for safety or weather-related reasons.
11.2 Insurance: Customers are strongly advised to secure their own travel insurance coverage for the duration of the trip.

12.1 Legal Framework: This Agreement is governed by UAE law, and the UAE courts have exclusive jurisdiction to settle any related disputes.12.3 Non-Transferability: This membership arrangement is strictly non-transferable and intended solely for the personal utilization of the Subscriber.

13.1 Personal Utilization: This membership arrangement is strictly non-transferable and intended solely for the personal utilization of the Subscriber.
13.2 Physical Presence: The Subscriber must be physically present during the course of each voyage.
13.3 Prohibition on Assignment, Transfer, or Sharing: The Subscriber is expressly prohibited from assigning, transferring, or sharing this membership with third parties or entities, whether for commercial purposes or otherwise.
Flexibility for Voyages: It is important to underscore that this membership affords flexibility exclusively for an array of voyage scenarios.
